Article 1 - Object and scope of application

 

Any order implies the acceptance without reserve by the purchaser and its full and whole adhesion to the present general conditions of sale, which prevail over any other document, and especially over all general conditions of purchase, except derogatory express and prior agreement of the Akkor International company.

These general conditions of sale apply to all sales by the Akkor International company, unless specific and prior agreement agreed in writing between the parties.

Any other document than the present general conditions of sale and in particular catalogs, prospectuses, advertisements, notices, has only informative and indicative value, not contractual.

Akkor International reserves the right to adapt or modify at any time the terms and conditions of sale, the version applicable to any transaction being the one appearing online on the site www.kozysocks.com at the time of the order.

 

Article 2 – Customers

 

The customer asserts to be a natural person over 18 years old and with legal capacity or holder of a parental authorization allowing them to order on the website. When registering the customer's personal data in the "my account" section, the latter must ensure the accuracy and completeness of the mandatory data provided. In case of any mistake in the contact details of the recipient, the Akkor International company cannot be held liable for the impossibility to deliver the product.  

 

Article 3 – Products

 

The products offered for sale (and therefore with payment obligation) are those described on the online store www.kozysocks.com. Akkor International takes great care in the presentation and description of these products to satisfy the customer's information. However, it is possible that non-substantial errors may appear on the online store, which the customer recognizes and accepts. In case of non-compliance of the product delivered with its description on the online store, the customer may either exercise their right of withdrawal or enforce the guarantee of compliance of the company, which will, if necessary, either exchange or refund the price (in whole or in part) invoiced.

 

Article 4 – Orders

 

Ordering on the kozysocks.com website is subject to compliance with the procedure set up by the Akkor International company, concretized by a succession of different steps that the customer must follow to validate his order. The customer will have the opportunity, before finalizing his order, to check its details to express his acceptance. Any order confirmed by the customer constitutes a sales contract and acceptance of all the stipulations herein. A confirmation email summarizing the order (products, price, quantity, etc.) will be sent to the customer by Akkor International. To this end, the customer formally accepts the use of e-mails by Akkor International for the confirmation of the order’s content. The invoices are added in PDF format to the order confirmation e-mail and are made available to the customer on the kozysocks.com website, in the customer's personal account, from the time the order’s payment is validated.

 

The company Akkor International will refuse any order for a legitimate reason under the code of consumption. For instance, may be considered legitimate a dispute or incident relating to the payment of a previous order or which would contravene the provisions hereof. In this case, Akkor International will inform the customer by e-mail. If the customer does not proceed to the correction of the elements that are erroneous or contrary to these terms and conditions of sale, Akkor International reserves the right not to process the order.

 

Article 5 – Delivery / shipping

 

The means, delays and delivery rates are detailed in the "Deliveries" section of the website www.kozysocks.com.

 

Beyond an order amount of 29€, KozySocks offers the delivery costs in Colissimo pick-up stations in Metropolitan France. For lower amounts, home deliveries or delivery addresses outside Metropolitan France, delivery costs are supported by the customer.

The order is delivered to the delivery address indicated by the customer, given that this must be the residence address of the customer or of any other natural person of their choice. Delivery cannot be made to hotels or post office boxes.

 

The delivery time corresponds to the shipping time by KozySocks plus the delivery time of the carrier. Shipping and delivery times are for informative and indicative purposes only. Akkor International is held to a simple obligation of means. The delays depend on the availability of the carriers and the order of arrival of the orders.

 

Akkor International strives to respect the delivery times indicated and to execute orders, with the exception of force majeure or circumstances beyond its control, such as strikes, ice, fire, storm, flood, epidemic, difficulties of supply, given that this list is not exhaustive.

Delays in delivery cannot give rise to any penalty or indemnity, unless there has been a gross misconduct by Akkor International.

 

In all cases of possible delays, whether for an internal cause (for instance closure for holidays, illness, incident) or external, customers waiting for delivery will be notified as soon as possible by Akkor International by email, and the closure will be announced on the website kozysocks.com (predictable closures will be indicated on time).

 

When after inspection, an apparent defect, a non-conformity of the product delivered to its description on the site www.kozysocks.com, a missing or an obvious delivery error is actually acknowledged by the company Akkor International, the customer will only be able to ask our company the replacement of the non-compliant items and / or the complement needed to fill the missing items at the expense of the company, without the customer being able to claim any compensation or the resolution of the order.

 

If the customer receives a damaged package (already open, missing products, etc.), they can either refuse directly to the carrier, or notify the conveyor and the company Akkor International, by any means, all reserves on the delivered product in the 3 days following the receipt of the product.

 

Article 6 – Returns, exchanges, refunds

6.1 Returns

 

Within 28 days of the delivery, the customer may return, at their expense, new products (in their original packaging, labelled, unworn, unwashed, in condition to be sold) accompanied by the order number and contact details, at the following address:

As part of the right of withdrawal, Akkor International will refund to the customer any sums already paid, including any shipping costs, under the conditions referred to in Article 6.3.


6.2 Exchanges

 

Any exchange is possible within 28 days of the delivery of the order. The customer must first contact KozySocks’ customer service (mentioning his contact information and order number), which will respond as soon as possible. The customer and KozySocks will agree by email on the article to be sent back instead.

 

Fees:

- The shipping costs for returning the products to be exchanged by the customer to KozySocks are at the expense of the customer. Nevertheless, KozySocks will pay the shipping cost of the second shipment with the new product in exchange.

- In the particular cases of a defective article, non-compliance of the article with its description on the www.kozysocks.com website or of a delivery error incumbent on KozySocks, the costs of return and exchange will be systematically supported by KozySocks.

 

6.3 Refunds

 

Refunds of products, in case of the use of the right of withdrawal or in case of non-compliance of the product delivered with its description on the site www.kozysocks.com, will be made by the company Akkor International within a maximum period of 14 days from the date on which it will be informed of the client's decision to retract. Nevertheless, it may defer refunds until recovery of the goods or until the customer has given proof of the sending of these goods.

 

The refund will be made according to the method of payment chosen by the customer at the time of the order, or by the delivery of a voucher of a value equal to the totality of the order (value all taxes included and shipping included) with the express agreement of the customer, and provided that the refund does not generate any costs for the customer.

 

Article 7 – Prices

 

Akkor International reserves the right to change its prices at any time. However, the products will be billed based on the prices in effect at the time of registration of the order, subject to availability.

 

The prices of the products are indicated in euros, all taxes included, without the shipping costs.

 

The total price of the order (all taxes and shipping included) is indicated in the basket.

 

Article 8 – Terms of payment

 

The products are payable in cash on the day of the actual order.

After completing the order, the customer must pay by credit card: the customer uses their credit card to pay for their order via the platform CM-CIC (Credit Mutuel Bank), dedicated to the payment by internet, and which ensures the security and the registration of the payment order. In this regard, the customer expressly acknowledges that the communication of his credit card number to Akkor International is worth debit authorization of his account for the products ordered. The credit card number does not pass through the site www.kozysocks.com, bank details cannot be visible or registered by KozySocks or the Akkor International company.

 

Article 9 - Loyalty Program

 

The Loyalty program is valid on the www.kozysocks.com website only, and therefore in no case on the stands of the Akkor International company during equestrian competitions and horse shows in France and Europe.

 

On the website, each purchase allows the customer to accumulate loyalty points that can be converted in vouchers: 1 loyalty point earned for 1 euro spent; 100 loyalty points earned can be converted into a 10€ voucher. The voucher is valid on kozysocks.com with no time limit, on any next order. The voucher is credited to the customer's account once he has earned 100 loyalty points and when his last order is delivered. Loyalty points are cancelled accordingly when a purchase is cancelled or refunded.

 

The customer consults on his own initiative his points balance on his account on the kozysocks.com website. The voucher must be used at once and cannot give rise to a refund or credit if it is not fully used. The voucher cannot be used to pay shipping costs.

 

Article 10 – Personal data: Computer and freedom

 

Pursuant to the entry into force of the General Regulations on Data Protection, KozySocks undertakes to respect and protect the personal data that you entrust to us.

10.3 Duration of retention

 

We do not store your personal data indefinitely in our computer files.

Your data is kept for 3 years if you do not make any purchase on our online store after creating your customer account, and 5 years from the day you made your last order.

All the brands, texts, annotations, works, illustrations or products, whether they are visual or sound, reproduced on the www.kozysocks.com website, are protected by copyright, trademark law, patent law and the right to image. They are the Akkor International company’s full property. Any reproduction or representation, in whole or in part, is constitutive of counterfeit that can engage civil and criminal liability. Applying a hypertext link onto the www.kozysocks.com website, using either technique of framing or deep linking, is strictly forbidden. Any reproduction, in total or in part, of the catalog www.kozysocks.com is strictly forbidden.

 

Article 12 – Liability

 

KozySocks’ products comply with the French legislation in force. Pictures are communicated for illustrative purposes. Customers are invited to refer to the description of each product in order to display its precise characteristics. In case of doubt or for any other complementary information, customers are welcome to contact the service Client de KozySocks.

 

Article 13 – Governing law

 

Any question related to the present terms and conditions or the sales that they govern that is not treated by these contractual stipulations will be governed by the French law excluding any other law, and, as a suppletive, by the Vienna Convention on the international sale of goods.

 

In case of difficulties or complaints related to an order, the customer can contact the customer service to find an amicable solution. The customer service of the online store is accessible here.

 

Annex – Legal guarantee of conformity and hidden defects

 

Article 1641 of the civil code:

 

The seller is bound by the warranty against hidden defects which render the sold product unsuitable for the use for which it is intended, or which diminish the use so much that the buyer would not have acquired it, or would have asked for a lower price, if he had known them.

 

Article 1648 of the civil code:

 

The action against latent defects must be brought by the purchaser within two years from the discovery of the defect. In the case provided for by article 1642-1, the action must be brought, under penalty of foreclosure, within one year from the date on which the seller may be discharged from apparent defects or defects of conformity.

 

Article L217-4 of the code of consumption:

 

The seller delivers a good that complies with the contract and responds to the lack of conformity existing at the time of delivery. It also responds to any lack of conformity resulting from the packaging, the assembly instructions or the installation when it has been charged to it by the contract or it has been carried out under its responsibility.

 

Article L217-5 of the code of consumption:

 

Any trader who becomes aware, after having acquired or transferred products, of the non-conformity of all or part of these with the regulation concerning a substantial quality, is obliged to inform without delay, by any means, the one who provided him with these products and those to whom he gave them.

 

Article L217-12 of the code of consumption:

 

The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.

 

Article L217-16 of the code of consumption:

 

When the buyer asks the seller, during the course of the commercial guarantee which was granted to him on the day of the acquisition or the repair of a piece of movable property, a restoration covered by the guarantee, any period of immobilization exceeding seven days is added to the duration of the warranty that remained to run.

This period runs from the time of the request for intervention of the buyer or of the provision for repair of the property in question, if this provision is subsequent to the request for intervention.
